By subscribing to, accessing, or using Protocol 7 AI (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not use the Service.
Protocol 7 AI reserves the right to update or modify these Terms at any time. Changes will be communicated via email to active subscribers and published on this page with an updated revision date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

In accordance with French law (Décret n° 2022-725), the legal denomination of the business includes the mention “EI” (Entrepreneur Individuel).
By completing a purchase through our third-party payment processor (Whop), you acknowledge and confirm that you have read, understood, and accepted these Terms of Service and the Privacy Policy in their entirety, regardless of the method used to access the checkout page.
Protocol 7 AI is a subscription-based market intelligence newsletter. The Service delivers algorithmically generated macro analysis, proprietary market indicators (including AlphaScout™, DEFCON, and DAEMON), and structured market briefings via email.
The Service includes three recurring publications delivered to the Subscriber’s registered email address:
Delivery times are approximate and may vary depending on data ingestion cycles and system processing. Protocol 7 AI may adjust delivery schedules and content format. Any material change to the nature or frequency of the Service will be communicated to active Subscribers at least 30 days in advance, and the Subscriber may cancel without penalty before such changes take effect.
Protocol 7 AI is an information and analysis service. It does not provide trading signals, buy or sell recommendations, or personalised financial advice of any kind.
Conformity guarantee: In accordance with Articles L224-25-1 to L224-25-32 of the French Consumer Code (Ordonnance n° 2021-1247), the Service is guaranteed to conform to the description provided in these Terms. If you believe the Service does not conform to its description, you may contact us at [email protected] to request a remedy in accordance with applicable law.
The Service is offered as a monthly subscription at a base price of €49 per month.
All payments are processed by Whop (Whop Inc.), acting as merchant of record. By subscribing, you also agree to Whop’s buyer terms. Whop handles:
Subscriptions automatically renew at the end of each monthly billing period unless cancelled by the Subscriber before the renewal date. You may cancel your subscription at any time through the Whop customer portal. Upon cancellation, you retain access to the Service until the end of the current paid billing period. No partial refunds are issued for unused portions of a billing period, except in the case of the right of withdrawal described in Section 4.
Easy cancellation: In accordance with French Law n° 2022-1158 of 16 August 2022 and Décret n° 2023-417, you may cancel your subscription online in three steps or fewer. Two methods are available:

Protocol 7 AI reserves the right to modify the subscription price. Any price increase will be communicated to active Subscribers at least 30 days in advance. If you do not accept the new price, you may cancel before it takes effect.
Late payment: As payments are processed by card via Whop, late payment penalties do not generally apply. In the unlikely event of a payment dispute handled outside Whop, late payment penalties shall apply at a rate of three (3) times the legal interest rate in force, in accordance with Article L441-10 of the French Commercial Code, plus a fixed recovery indemnity of €40.
Discretionary refunds: Outside of the statutory right of withdrawal (Section 4) and the delivery failure provisions (Section 9), Protocol 7 AI may, at its sole and absolute discretion, issue full or partial refunds on a case-by-case basis in exceptional circumstances (e.g. verified technical issues preventing access to the Service, duplicate billing errors). Such refunds, if granted, shall not create a precedent or an obligation to grant similar refunds in future cases. Refund requests must be sent to [email protected] within 30 days of the relevant billing event.
In accordance with Article L221-18 of the French Consumer Code, consumers purchasing services at a distance have a right of withdrawal (droit de rétractation) of 14 calendar days from the date of subscription, without needing to provide any reason.
To exercise your right of withdrawal, you must send an unambiguous written statement to [email protected] before the expiry of the 14-day period. You may use the model withdrawal form below, but it is not obligatory.

If you exercise your right of withdrawal, we will reimburse all payments received from you, without undue delay and no later than 14 days from the day on which we receive your withdrawal notification. The refund will be issued via Whop using the same means of payment as the original transaction. No fees will be charged for the refund.
Early execution: If you have explicitly requested that the Service begin delivery before the end of the 14-day withdrawal period, you acknowledge that:
If you are not informed of this right of withdrawal, the withdrawal period is extended by 12 months from the end of the initial 14-day period (Article L221-20).
This right of withdrawal is provided in compliance with Articles L221-18 to L221-28 of the French Consumer Code and the EU Consumer Rights Directive 2011/83/EU.
Protocol 7 AI provides algorithmically generated macro analysis and market indicators for informational and educational purposes only. The content of the Service does not constitute investment advice, financial advice, trading advice, or any other form of personalised recommendation within the meaning of Directive 2014/65/EU (MiFID II).
Nothing in any Protocol 7 AI publication should be construed as a recommendation, solicitation, or offer to buy or sell any security, financial instrument, cryptocurrency, or other asset.
Protocol 7 AI is not registered with the AMF (Autorité des Marchés Financiers) as a Conseiller en Investissements Financiers (CIF) under Article L541-1 of the French Monetary and Financial Code, and does not hold any investment advisory licence in any jurisdiction. Protocol 7 AI does not provide any service on crypto-assets as defined under MiCA (EU Regulation 2023/1114).

Protocol 7 AI operates an algorithmic trading system on Darwinex. Positions held by the system may overlap with assets discussed in publications. Proprietary indices (AlphaScout™, DEFCON Engine, DAEMON) measure market activity magnitude — they are not buy or sell signals.
Past algorithmic performance is not indicative of future results. Markets involve substantial risk of loss, including the possible loss of all invested capital. All investment decisions are made at your own sole risk and responsibility.
You acknowledge that you are solely responsible for your own investment decisions and that Protocol 7 AI bears no responsibility for any losses, damages, or costs resulting from actions taken or not taken based on the content of the Service.
All content delivered through the Service — including briefings, reports, proprietary indices (AlphaScout™, DEFCON, DAEMON), methodologies, scoring systems, algorithms, text, graphics, and data visualisations — is the exclusive intellectual property of Protocol 7 AI, protected under the French Code de la propriété intellectuelle and applicable international copyright law.
Your subscription grants you a personal, non-transferable, non-exclusive, revocable licence to access and read the content for your own individual use. No other rights are granted.
The Protocol 7 AI name, logo, and all associated branding are trademarks of Protocol 7 AI. You may not use these marks without prior written authorisation.

Any violation of these terms may result in suspension or termination of your subscription. In the event of termination for cause, access will cease immediately and a pro rata refund of the remaining billing period will be issued. Protocol 7 AI reserves the right to pursue legal proceedings for damages in cases of wilful infringement.
To the maximum extent permitted by applicable French law, Protocol 7 AI shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of the Service, including but not limited to damages for loss of profits, loss of data, business interruption, or investment losses arising from decisions made in reliance on the content of the Service.
Protocol 7 AI endeavours to provide accurate and timely content but does not guarantee the accuracy, completeness, timeliness, or reliability of any content provided through the Service.
In any event, Protocol 7 AI’s total aggregate liability to you for all claims arising from the Service shall not exceed the total amount paid by you during the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct (faute intentionnelle ou dolosive), or any liability that cannot be excluded or limited under applicable French law, including mandatory consumer protection provisions of the Code de la consommation.
Protocol 7 AI targets a monthly delivery rate of 95% for scheduled issues (approximately 29 out of 31 daily briefings per month). This target is provided on a best-effort basis and does not constitute a contractual guarantee.
Delivery may be temporarily interrupted due to circumstances beyond Protocol 7 AI’s reasonable control, including but not limited to: technical failures of third-party infrastructure (email delivery providers, payment processors, data sources), force majeure events, or scheduled maintenance.
In the event that delivery falls materially and persistently below the 95% target over two or more consecutive billing periods due to causes within Protocol 7 AI’s control, affected Subscribers may, at their choice, request a pro rata refund of the affected billing period(s), a credit applied to the next billing period, or cancel their subscription in accordance with Section 3.
Protocol 7 AI maintains a local subscriber cache to ensure that email delivery can continue even in the event of a temporary outage of the subscription management platform. Subscribers will not lose access to the Service due to third-party platform outages.
Service status and known issues will be communicated to active Subscribers by email or via the Protocol 7 AI social media channels where reasonably practicable.
Protocol 7 AI collects and processes personal data in connection with the provision of the Service, including your email address, name, and payment information (processed by Whop as merchant of record).

These Terms are governed by and construed in accordance with the laws of France.
In the event of a dispute, Protocol 7 AI and the Subscriber agree to first seek an amicable resolution. Any written complaint must be sent to [email protected]. Protocol 7 AI will respond within 30 days.
Consumer mediation: In accordance with Articles L611-1 to L616-3 of the French Consumer Code, if a dispute has not been resolved through a prior written complaint, you may submit the matter free of charge to the following consumer mediator:

European consumers may also file a complaint via the European Commission’s Online Dispute Resolution (ODR) platform.
If no amicable resolution can be reached, disputes shall be submitted to the exclusive jurisdiction of the competent courts of France.
International subscribers: These Terms are governed by French law. In accordance with Regulation (EC) No 593/2008 (Rome I), the choice of French law does not deprive consumers residing in the EU of the protection afforded by the mandatory consumer protection rules of their country of habitual residence. For subscribers outside the EU, French law applies exclusively.
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from a force majeure event within the meaning of Article 1218 of the French Civil Code.
Force majeure events include, but are not limited to: natural disasters, epidemics or pandemics, acts of war or terrorism, government sanctions or embargoes, cyberattacks, power grid failures, failures of internet infrastructure, actions of regulatory authorities, and any other event that is beyond the reasonable control of the affected party, could not have been reasonably foreseen at the time of entering into the contract, and whose effects cannot be avoided by appropriate measures.
The affected party shall notify the other party as soon as reasonably practicable. If the force majeure event continues for more than 60 consecutive days, either party may terminate the subscription by written notice, and the Subscriber shall receive a pro rata refund for the unused portion of the billing period.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect. The invalid provision shall be replaced, to the extent possible, by a valid provision that most closely reflects the original commercial intent of the parties.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Protocol 7 AI with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
The fact that Protocol 7 AI does not exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
